Welcome to REPS. REPS is presently operated by its founding team on a pre-registration basis, pending formal incorporation of a legal entity in India. This section will be updated with REPS's registered legal entity name, registered office address, and Corporate Identification Number (CIN) upon completion of incorporation. Until such time, references to "REPS", "we", "us", or "our" in these Terms refer to the founding team currently operating the Platform.
REPS is a technology-enabled online platform that enables users to discover, compare, and book fitness services. Through the REPS website and mobile application, users can browse partner gyms, check available facilities, reserve time slots, make online payments, and access related services.
REPS acts solely as an intermediary technology platform connecting customers with independent gym partners. REPS does not own, manage, lease, operate, supervise, or control any gym, fitness center, trainer, equipment, or fitness program listed on the platform. All fitness services are independently owned and operated by the respective gym partners.
By accessing, browsing, registering, or using any part of the REPS platform, the user acknowledges that they have carefully read, understood, and agreed to be legally bound by these Terms of Service, the Privacy Policy, Refund and Cancellation Policy, and any other policies published by REPS from time to time.
If you do not agree with any provision of these Terms, you must discontinue the use of the Platform immediately.
For the purposes of these Terms, unless the context otherwise requires:
The Platform is intended for individuals who are legally competent to enter into binding contracts under the applicable laws of India. Account registration is restricted to individuals who are fourteen (14) years of age or older. Because our system currently lacks automated age verification and verifiable parental consent mechanisms, we rely on your self-declaration. If you are between fourteen (14) and seventeen (17) years of age, you represent and warrant that you are using the Platform with the explicit consent and supervision of your parent or legal guardian, who accepts these Terms on your behalf.
An Account Holder may add one or more guests to a booking. Our platform's booking flow currently allows an Account Holder to add guests by merely selecting the number of attendees. There is no technical age or relationship validation at this step. Despite this system allowance, it is a strict violation of these Terms for an Account Holder under the age of eighteen (18) to add or supervise minor guests. Where a Guest is below eighteen (18) years of age, that Guest must be added and accompanied by an Account Holder aged eighteen (18) or older.
Partner gyms retain sole discretion to refuse entry to any minor (under 18) or require adult supervision in accordance with their own house rules, regardless of whether the platform allowed the booking to proceed.
By registering on REPS, the user represents and warrants that all information submitted during registration is accurate, complete, and up to date. Users shall be solely responsible for maintaining the confidentiality of their account credentials and for all activities carried out using their account.
REPS reserves the right to suspend or permanently terminate any account that is found to contain inaccurate information, fraudulent activity, impersonation, or misuse of the Platform.
REPS provides an online technology platform through which users can search for fitness centers, compare available facilities, reserve gym slots, make payments, receive booking confirmations, and communicate with participating gyms.
The Platform does not guarantee the availability, quality, safety, legality, suitability, cleanliness, or effectiveness of any gym, trainer, equipment, or fitness service. The responsibility for providing fitness services remains entirely with the respective partner gym.
REPS shall not be considered a service provider for the actual fitness activities performed by the gym. The Platform merely facilitates discovery, booking, payment processing, and communication between users and partner gyms.
REPS functions solely as a technology intermediary connecting users with independent fitness centers.
Accordingly, REPS shall not be responsible or liable for any injury, accident, illness, health complication, theft, loss of personal belongings, property damage, trainer misconduct, equipment malfunction, inaccurate information provided by gyms, cancellation of services, or dissatisfaction arising from services delivered by partner gyms.
All trademarks, logos, graphics, software, source code, website design, mobile application content, databases, text, photographs, videos, and other intellectual property associated with REPS remain the exclusive property of REPS or its licensors.
No part of the Platform may be copied, reproduced, modified, distributed, reverse engineered, or commercially exploited without prior written permission from REPS.
REPS collects and processes certain personal information from Users to enable registration, booking, and payment functionality on the Platform, including but not limited to name, date of birth, contact details, and health-related declarations (such as self-certified medical fitness and safety acknowledgements) provided during onboarding.
All collection, storage, use, and processing of personal data by REPS is governed by our Privacy Policy, which forms an integral part of these Terms and is available on the REPS website and mobile application. Users are advised to read the Privacy Policy carefully before using the Platform.
Certain information collected by REPS, including health-related declarations, may constitute sensitive personal data under the Digital Personal Data Protection Act, 2023 ("DPDP Act") and applicable rules made thereunder. REPS processes such data only for the purposes disclosed in the Privacy Policy and in accordance with the consent obtained from the User at the time of collection.
Users have the right to access, correct, and request deletion of their personal data in accordance with the DPDP Act and the mechanisms described in the Privacy Policy.
For users between fourteen (14) and seventeen (17) years of age, REPS relies on the user's representation that parental or guardian consent has been obtained prior to data collection. We process personal data based on this self-declared consent to fulfill our obligations under the DPDP Act. Parents or guardians may revoke this consent at any time by requesting account deletion.
REPS aims to address user complaints and grievances relating to the Platform promptly. A formally designated Grievance Officer, as contemplated under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, will be appointed and named in this section prior to the Platform's public launch to external users.
Until such appointment, users may direct any complaint, question, or grievance regarding the Platform to:
Email: hello.reps.help@gmail.com
REPS shall acknowledge receipt of the complaint and endeavour to resolve it within a reasonable time.
REPS reserves the right to suspend, restrict, or permanently terminate any user account without prior notice if it reasonably believes that the user has violated these Terms of Service, engaged in fraudulent activities, misused the Platform, or acted in a manner that adversely affects other users, partner gyms, or the Platform itself.
Termination shall not affect any rights or obligations accrued prior to the date of termination.
REPS may modify these Terms of Service from time to time to reflect changes in business practices, legal requirements, technology, or operational processes, including to reflect the completion of company incorporation.
Updated versions shall become effective immediately upon publication on the Platform. Continued use of the Platform after such publication shall constitute acceptance of the revised Terms.
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India.
Any disputes arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts at Chennai, Tamil Nadu, India.
