Privacy Policy

1. Introduction

This Privacy Policy explains how REPS ("we", "us", "our") collects, uses, discloses, and protects personal information when you use the REPS website and mobile application (the "Platform"). REPS is presently operated by its founding team on a pre-registration basis, pending formal incorporation of a legal entity in India; this Policy will be updated with the registered legal entity's details upon completion of incorporation.

By accessing or using the Platform, you consent to the practices described in this Privacy Policy. This Policy should be read together with our Terms of Service.

2. Information We Collect

We collect the following categories of information:

  • (a) Account information: name, phone number, email address, and date of birth, provided during registration.
  • (b) Onboarding and eligibility information: age verification status, self-certified medical fitness confirmation, and acceptance of safety guidelines, collected to confirm your eligibility to book fitness sessions.
  • (c) Booking information: gym and slot selections, booking history, check-in status, and any guests added to a booking (including whether a guest is a minor, added by a parent or legal guardian in accordance with our Terms of Service).
  • (d) Payment information: REPS does not collect, store, or retain your debit card numbers, credit card details, UPI PINs, or banking passwords. Payments are processed directly through our third-party payment gateway provider, Razorpay, which maintains its own privacy and security practices.
  • (e) Usage information: technical information such as device type, app version, and general usage patterns on the Platform, collected to maintain and improve the Platform.
  • (f) Communications: any information you provide when contacting us for support or raising a grievance.

3. How We Use Your Information

We use the information collected to:

  • create and manage your account;
  • verify eligibility to use the Platform, including age-related eligibility;
  • process bookings, facilitate check-in at partner gyms, and process payments through Razorpay;
  • communicate with you regarding bookings, confirmations, cancellations, and support requests;
  • maintain the safety, security, and integrity of the Platform;
  • improve and develop the Platform's features and services;
  • comply with applicable legal and regulatory requirements.

4. Health-Related Information

As part of onboarding, we collect a self-certified confirmation of medical fitness and acceptance of safety guidelines. This information may constitute sensitive personal data under the Digital Personal Data Protection Act, 2023 ("DPDP Act"). We collect this information solely to confirm your eligibility to safely use partner gym facilities, and it is used only for that purpose. We do not use this information for any medical, diagnostic, or advisory purpose, and REPS does not provide medical advice of any kind.

5. Minors and Guest Bookings

REPS permits account creation by individuals who are fourteen (14) years of age or older. Under the Digital Personal Data Protection Act, 2023, processing personal data of individuals under eighteen (18) requires parental or guardian consent. Currently, our platform relies on user self-declaration for age and parental consent. By creating an account, users aged 14-17 represent that they have obtained consent from a parent or legal guardian. If we are notified or discover that a user under 18 has registered without such consent, we will promptly delete or anonymize their personal data.

Furthermore, our booking system currently allows users to specify the number of guests without collecting the guests' ages or verifying relationships. However, Account Holders are solely responsible for ensuring they have the legal authority to provide guest data to us. Parents or guardians who wish to review or request deletion of their child's data should contact us immediately.

6. Sharing of Information

We share information only as follows:

  • (a) With partner gyms, to the extent necessary to confirm and honour a booking (such as booking details and check-in verification).
  • (b) With Razorpay, our payment gateway provider, to process payments. Razorpay's handling of payment data is governed by its own privacy policy.
  • (c) With cloud infrastructure and database service providers that host Platform data on our behalf, under appropriate confidentiality and security obligations.
  • (d) Where required by applicable law, regulation, or a valid legal process.

We do not sell your personal information to third parties.

7. Cookies and Similar Technologies

The Platform may use cookies or similar technologies for basic functionality and to understand general usage patterns. You can control cookie preferences through your browser or device settings; disabling cookies may affect certain Platform features.

8. Data Retention

We retain personal information for as long as necessary to provide the Platform's services, comply with legal obligations, resolve disputes, and enforce our agreements. When information is no longer required for these purposes, we take reasonable steps to delete or anonymise it.

9. Data Security

We take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, or alteration. However, no method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security.

10. Your Rights Under the DPDP Act

Subject to applicable law, you have the right to:

  • access the personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • request deletion of your personal information, subject to our legal and legitimate business retention requirements;
  • withdraw consent for processing, where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal.

To exercise any of these rights, please contact us using the details in Section 12 below.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or the completion of company incorporation. Updated versions will be published on the Platform, and continued use of the Platform after publication constitutes acceptance of the revised Policy.
